Samsung said in a legal document submitted on Monday that after the iPhone5 went public, they immediately investigated the product and found that the iPhone 5, like the early iPhone, iPad and iPod Touch, infringed the company's two standard element patents and six functional patents. Therefore, Samsung decided to add this allegation to the previously filed patent lawsuit.
Before the release of the iPhone 5, Samsung said that the iPhone 5 supporting the LTE network must infringe Samsung's patents, and Samsung will sue Apple in South Korea, Europe and even the United States, demanding that the court ban the iPhone 5 in the region or country. Samsung said in the prosecution statement that "we have no choice but to take the necessary measures to protect our innovation and intellectual property rights." However, as of now, Samsung has not filed a lock-up order with US courts.
The patent war between Samsung and Apple seems to be moving in the direction of Samsung's favor. It is reported that US District Court Judge Lucy Koch canceled the Samsung Galaxy Tab 10.1 tablet computer in the US market, because the jury on August 24 ruling Samsung this product did not infringe Apple's design patent.
As the world's two largest high-end mobile phone manufacturers, Apple and Samsung have launched a number of mobile device patent litigation in four continents, hoping to dominate the $219 billion smartphone market. Although the US courts have already ruled that Samsung will compensate Apple for $1 billion, the "century war" between the two sides is far from over.
